Terms & Conditions

1. GENERAL

The terms and conditions set out below are applicable to the supply of products made by Buschbeck Outdoor Living Ltd to the buyer, hereafter referred to as the Customer.

2. PRIVACY

2.1 We do not send random marketing e-mails to personal e-mail addresses (SPAM).

2.2 We make use of the following cookies – frontend, __utma, __utmb, __utmc,__utmz, these are used for standard shopping cart functionailty and anonymous website usage details.

2.3 We do not collect information deemed “sensitive” under the Data Protection Act 1998. Your address details (but NOT your credit card details, see below) are retained on a restricted access system within our internal systems which is in keeping with both our security policy and the law.

3. PRICING

3.1All prices are quoted in Pounds sterling.

3.2 All prices are inclusive of carriage charges for delivery to all UK mainland destinations.

3.3 Carriage charges to all other destinations other than the UK mainland are available upon enquiry with Buschbeck Outdoor Living Ltd.

4. PAYMENT

4.1

4.1 Payments must be made in Pounds sterling only, unless otherwise specified, by one of the following payment methods:

Major credit cards as listed: MasterCard, Visa, Switch, Solo, Visa Delta.
Cheques made payable to Buschbeck Outdoor Living Ltd.
Bank transfer direct to Buschbeck Outdoor Living Ltd.

4.2

Buschbeck Outdoor Living Ltd are responsible for any website transactions but do not retain your credit or debit card details on its systems. When you reach the page for entering your card information, you are connected directly to the Sagepay secure server – you can tell this by the change in the web address on your browser. Card details are entered on a secure page and transferred using an encrypted SSL on SagePay’s servers. SagePay are our payment service provider, and will process any charges or refunds to your card. We use SagePay because they offer the leading industry standard in secure payment transactions, and they are one of the largest Internet payment service providers in Europe.

5. TRANSFER OF RISK

The risk in the goods shall fully pass to the Customer once the goods have been delivered by our nominated transport provider and signed for.

6. DELIVERY

6.1

All products are despatched from our warehousing facilities. Unless requested by the Customer, all products must be signed for at the time delivery is made. The Customer must request any alternative delivery method at the time of the ordering and goods will be despatched at the Customers own risk.

6.2 SHIPPING CHARGES

All the products contained on our website are delivered free of charge to the vast majority of the U.K. mainland. However, we currently do not deliver to Northern Ireland, the Republic of Ireland, Jersey or Guernsey. For deliveries to Northern Ireland, Southern Ireland and the Scottish Isles & Highlands additional carriage charges will be applicable. If you are in doubt please call us to confirm these charges prior to ordering.

6.3 DELIVERY DATE

Buschbeck Outdoor Living Ltd aim to deliver all goods within four working days from processing of payment. Despatch normally takes place on the same day as payment is processed. Any orders which will exceed 28 days to fulfil, the Customer will be notified in writing and will be offered the option of order cancellation and a refund of payment. Any products not available at the time of ordering will be despatched to the Customer as soon as is possible. Buschbeck Outdoor Living Ltd cannot be held responsible for delays in the delivery caused by our suppliers or transport providers.

6.4 EXPRESS SHIPPING

In many cases we are able to ship orders on a “Next Day” delivery basis for an additional charge. If you require this service please enquire with us to confirm the availability of the product and the additional cost for transportation prior to ordering.

6.5 SCOPE OF DELIVERY SERVICE

Our transport providers will deliver your Buschbeck masonry barbecue fireplace to the nearest kerbside vehicular access point at the delivery address and are under no obligation to place the barbecue or any of its components any nearer to the barbecues final position. We only offer a kerbside delivery service for masonry products.

7. ACCEPTANCE

7.1 Please inspect your goods on delivery and contact us promptly if there is a problem. Your statutory consumer rights are not affected by inspection or acceptance of the goods. This does not limit your rights if a fault becomes apparent later.

7.2 MISSING ITEMS
Please report missing items within 5 days of delivery where possible so we can investigate promptly. This request does not limit your statutory rights.

8. RETURNS PROCEDURE

8.1

For consumer purchases made online, by telephone or by mail, you may cancel without giving a reason by notifying us within 14 calendar days after the day you receive your goods. You then have a further 14 calendar days after notifying us to send the goods back. Please follow the returns process below to help us handle your return. A returns number is an administrative aid and does not affect your statutory right to cancel.

8.2

Please contact Buschbeck Outdoor Living Ltd by telephone or email to notify us of cancellation and obtain return instructions. A returns code will be issued and must be referred to in all correspondence. This number must also be clearly marked on any returned packages. Buschbeck Outdoor Living Ltd willarrange for the relevant packages to be collected from the Customer. A collection charge will apply to returns where goods are not damaged or faulty.

8.3

If goods are faulty, damaged or not as described, please contact us. We will arrange return or collection at our cost and provide the refund, repair or replacement to which you are entitled under consumer law. These rights are separate from the change-of-mind cancellation period. The faulty or damaged product must be returned to the location specified by Buschbeck Outdoor Living Ltd before the refund or replacement can be issued. For change-of-mind cancellations, we refund without undue delay and within 14 days after receiving the returned goods or evidence that they have been sent back, whichever is earlier. If we offer to collect the goods, we refund within 14 days of being told of your cancellation. We refund the original payment method unless you agree otherwise, including any standard outbound delivery charge; any additional cost for an upgraded delivery service is not refundable.

8.4

If you purchased your COSTCO Buschbeck Masonry Barbecue from COSTCO Wholesale UK and have a service related enquiry or needto discuss your purchase please contact Costco UK directly.

9. CANCELLATIONS

9.1

You may cancel a consumer distance order before dispatch or within the cancellation period in section 8.1 after delivery. If the order has already been dispatched, follow the returns procedure in section 8. Your statutory cancellation rights do not depend on obtaining prior authorisation.

9.2

Cancellations can be made either by telephone or by e-mail directly with Buschbeck Outdoor Living Ltd. Please remember, order despatch normally takes place the same day as payment is processed.

9.3

For change-of-mind returns, please notify us within the period in section 8.1 and request return instructions. The cost and risk of returning these goods is solely the customers. We do not charge a restocking fee. We may reduce your refund for loss in value caused by handling beyond what is necessary to establish the nature, characteristics and functioning of the goods, as permitted by law. Buschbeck Outdoor Living Ltd can organise the collection of these goods and the cost subtracted from the amount to be credited to the customer or the goods can be shipped and paid for by the customer ontheir own nominated carrier with the appropriate insurance cover. Please return all components and accessories, using the original packaging where possible or suitable protective packaging. You may open the packaging and inspect the goods as you would in a shop. Opening packaging alone does not remove your cancellation rights.

10. LAW

These terms and conditions are governed and shall be interpreted in accordance with U.K. Law.
